HAVRE SCHOOL DUH! CREW

Well here we go again. The Duh! Crew made some decisions regarding the Highland Park School addition last night at the regularly scheduled school board meeting.

The foundation contract was awarded to Electric City Concrete of Great Falls since not one Havre contractor even placed a bid on the project. Apparently the Havre contractors have now accepted thier dimished stature in life and won't cause anymore problems.  The project manager from Anderson Construction told the board that this bid was several thousand dollars below the project estimate. Several thousand? Well, let’s just call that 3 thousand to be safe, now keep a tally because we will be adding up all these below estimate savings at the end of the project to see if they jive with what the ending numbers are, which we assume to be unlikely. Next, the excavation contract was awarded to Havre contractor Patrick Construction which was also miraculously “several thousand” dollars below original cost estimates. Let’s again for sake of future argument, call that number 3 thousand.

A person from the audience asked the board if these sub-contractors and the illustrious Dick Anderson Construction provided the school district taxpayers with any performance bonds. The answer was “Duh, we don’t know for sure, we will have to check with the architect. When asked why this wasn’t required to protect the interests of the owner, in this case the tax-payers of Hill County, again the response was “Duh, we don’t know for sure what a bond is or does but we will check into it” I get a warm fuzzy feeling knowing that we have Shad and Harvey, the school’s “construction experts” looking out for our best interests. It is also interesting to note that the person that dared ask this bonding question at the public school board meeting was reported to have also received the “evil eye” from most of the board members. Perhaps he should remember the former blog where a contractor dared ask a question and was accused of “dung stirring.”

A surety bond is not an insurance policy. A surety bond is a guarantee, in which the surety guarantees that the contractor, called the “principal” in the bond, will perform the “obligation” stated in the bond. For example, the “obligation” stated in a bid bond is that the principal will honor its bid; the “obligation” in a performance bond is that the principal will complete the project; and the “obligation” in a payment bond is that the principal will properly pay subcontractors and suppliers. Bonds frequently state, as a “condition,” that if the principal fully performs the stated obligation, then the bond is void; otherwise the bond remains in full force and effect.

If the principal fails to perform the obligation stated in the bond, both the principal and the surety are liable on the bond, and their liability is “joint and several.” That is, either the principal or surety or both may be sued on the bond, and the entire liability may be collected from either the principal or the surety. The amount in which a bond is issued is the “penal sum,” or the “penalty amount,” of the bond. Except in a very limited set of circumstances, the penal sum or penalty amount is the upward limit of liability on the bond.

The person or firm to whom the principal and surety owe their obligation is called the “obligee.” On bid bonds, performance bonds, and payment bonds, the obligee is usually the owner. Where a subcontractor furnishes a bond, however, the obligee may be the owner or the general contractor or both. The people or firms who are entitled to sue on a bond, sometimes called “beneficiaries” of the bond, are usually defined in the language of the bond or in those state and federal statutes that require bonds on public projects.

Building and performance bonds costs borne by a contractor are usually 1-2% of the bid amount. Let’s see, 1.3 million x 1 ½% is about $20,000. We also noticed that the school building project has already shrunk from the advertised 9,800 square feet for 1.3 million to 9,500 square feet for 1.3 million. That equates to $133 per square foot of building so at $133 per ft x 300 feet we have already cut the cost by $39,900.Ok people, add this $39,900 to the $20, 000 and the several thousand twice from above ($6,000 or so) and you can see where this project is going to turn out to be a wonderful deal. Not even started and already we have “saved $65,900. Write these numbers down because there is going to be a little math test in the upcoming months where we will be deducting all of our good deal numbers from 1.3 million and comparing that to the total final cost of the out-of-town contractor.

In further school news, school clerk Zella Witter reported that high school student numbers are down by 40 kids which cut their revenues. Montana schools estimate it costs about $7,000 to educate a student. If voters do not approve the mill levy this year the budget will take another hit of $45,200. Witter was quoted as saying that the “high school struggles to maintain its programs now and any cuts would have a negative impact”

Let us put this in simple terms we hillbillies can understand. We can piss off $200,000 dollars for a 7 month Superintendent, we can send what tax money we do have to out of town contractors, but a failure of a $45,200 mill levy will ruin the school as we know it?

Hmm……What to do? What to do? VOTE NO, NO AND HELL NO TO ANY AND ALL SCHOOL MILL LEVIES!

    1) Under what Premis,Policy,Law,
    that he is using to NOT answer the
    Question:What is Mahon's"Personal reason"
    2)what Authority he claims, to be able to just"Do Away" with due process on the matter
    3) on what Authority does he have the power to just pay anyone he wants, for anything he deems neccasary,even AFTER the other party says they will donate thier time! Extra pay to carlson for answering a phone & e-mails,(Part of the civic duty)but extra pay anyway...how much asks Huston....I got an open Check-Book...and I don't even have to answer for it cause I am Omni-potent...How dare those little slaves Question ME!!!

  3. Some other questions you may want to ask NEO:

    Do you think it is ethical for an elected ody to keep this info secret from their employer, the tax-payer?

    Have they ever accepted gifts (like hookers) from Anderson Construction?

    Where is Mahon? (where arre they mailing the checks)

    Have they made deals with the Havre Daily News to suppress informatiton that may be floating around the community?

    Do they sleep well at night, knowing the have financially raped the tax payers of Havre, and short changed Havre youth of dollars intended for their education?

    Do they really expect voters to just give them more money!?

According to the HDN and Witter the next school year budget is only 4.5 million although according to the open school project the HS has a budget of over 6 million! why such a difference? but if it is really 4.5 million then $45,000 is 1 % decrease in budget for a 6% decrease in enrollment. Asking the school to cut 1% seems like absolutely nothing. 'specially since the state is going to be taking at minimum a 5% cut. How much will they have to cut without the mill levy?

  8. This wonderful contractor@ risk process should have Dick Anderson under bond. If the project goes over budget it is on the contractor not the tax payer. IF they are not under bond then this is not contractor at risk, we the tax payer are at risk!

  11. I'm tired of the school board using children to increase their budget. I have herd that if mills do not pass that the end result is students suffer how is that allowed. If spending dose not have to be explained to the tax payers than how is it that we the tax payers can trust the board to spend our money? I seen the HDN reported that the Gildford colony was to recieve funding to start the process of geting a new school my question is why can't these students be bussed to a school on the Hi line Turner colony sends students to the Turner school.In these hard economic times I for one do not have lots of extra money to throw around so I would like to think that our local government and schools should take percautions with their spending.

    It is my understanding that both Shad Huston and Dave Mahon are Masons.

  14. I agree with the No to all mill levys.
    These guys waste money on all sorts of crap and then holler that we are hurting the students and programs

    Take the money out of travel, conferences, schoolboard lunch,building reserve fund,wasted wages paid for 7 month contracts, and other things that can be cut back. When there is a mill levy election the school always gathers up all the teachers and classified staff and threatens them with thier jobs if the levy doesn't pass.... blackmails them into voting for the levy.

    When this levy fails we all need to be at the next schoolboard meeting to demand they cut overhead and administration, not teachers or programs

    DAM IT........WE PAY FOR THE SCHOOLS. OUR KIDS EDUCATION IS THE PRODUCT WE BUY. LETS STAND UP TO THE BIG BULLIES!!!!!!!!!!

  16. I agree with the Corrector. I will not only be voting No to any mill levies but also No to all incumbent board cndidates

    I agree with those that say the taxpayers should take back control of the school system. Let the teachers teach, let the students learn, and do some chopping in the rest of the budget to eliminate the need for an additional mill levy

  18. The school funding elections can always be avoided if the board actually paid attention to how the money was being spent

    Maybe they could also cut out the thousands of dollars they spend each year for lobbying for more money in Helena? When we want something we go lobby ourselves for free. Take a day off work and do it

    seems this Shad Huston Graduated from K-G in 1994,was on the campus master plan steering commitee ASMSU,Billings...has a BS degree...lol...resigned as admissions specialist in 2002 ASMSU
    I dont think that he has EVER had a JOB...I found Mahon...he's in Wordan,MT...406-967-2540?
    he has a face-book account also...I read all of the newspaper accounts & stories on the HUSTON/MAHON connection & I have concluded that there were very big "RED FLAGS" on Mahon about the Huntly thing...he got hired here anyway...over-looking other candidates that were JUST FINE! Huston claims he contacted the MSBA
    about Mahons Resignation,(What would they Know about Contract Law?) I cant find anything where he says he contacted any Legal Resources to inform him on how to proceed about fullfilling the contract or denying it and letting the whole thing go thru proper channels to get resolved...NO NO NO..HE made the desicion alone to just PAY it forward and be done with it!! The guy is just there to spend as fast & as Much as he can while he is in that position...I'll bet that the board members dont go along with what he decides ,only they are somehow denied the right to express it!! by a policy or set standards...looking it up to dbl chk...

Well, I went to the February school board meeting and calmly asked the trustees and administration present to answer to taxpayers' inquiry into why it is in our best interests as a community to pay a superintendent who left for personal reasons an additional $97,000. I have yet to get a direct response. I can only assume that there was something "special" about Dave Mahon's relationship that allowed him to leverage such a sweet deal. Both Kirk Miller and Dennis Parman resigned for personal reasons prior to the first year of new contract being finished; no sweet deals negotiated. Again, without clarification from School Board (hate to use the word Trustees) it can only be assumed that something horrible happened and it would have been more costly for HPS to go through lawsuit and not prevail. I am not comforted by the statement that the Montana School Board Association was consulted...hello, aren't they the responsible party for approving the contract? Didn’t they help find and recruit Mahon? If there was a costly error in the contract MSBA probably would advise HPS to cover it up and pay Mahon for his silence. Asking MSBA for guidance is like asking a co-conspirator to investigate and remedy his own crime? Reading other blog entries and justified comments from concerned community members, some things becomes apparent, but not transparent: the current HPS School Board and Administration can do a better job of engaging in productive dialogue so we can work together to build, and repair, our "tradition of excellence". I don't want to blame anyone and I don't care what Mahon's personal reasons are. What I care about are future mill levies that may not be approved, progress will not be achieved, and worse...all because those entrusted to be responsible and responsive in the elected positions as School Board Trustees failed and made no attempt to repair. THIS WILL COST OUR SCHOOL DISTRICT MORE THAN $97,000. I don't think the answer is replacing the school board, as we are already suffering from inexperience and lack of leadership. The answer lies in the community coming forward and demanding accountability and enforcing our right to question when it is clear a bad choice has been made. As parents and adults, we constantly preach to children and the younger generations to “make good choices”…how dare we sit by and not do a better job! What example does this provide for them? Let the current trustees who genuinely care, correct what is perceived to be a huge error and move forward. A little communication and cooperative goes a long way with establishing trust and making progress. I would support those who had the dignity, grace and leadership to respond to the Havre community and do just that. Not too much to ask and it would cost a lot less than where we are headed if nothing is done.

  23. Great points Kevan. I am still voting no to any mill levy but you are right on the money. I also hate to give any credit to our worthless news paper but they did have a decent editorial about this in tonights paper

  24. Remember what I said about CRIMINALS...no such thing as a smart one....this matter should get the attention of the MT ATTY GENERAL....there was an attemted THEFT here and the arrogance of the criminal mind is that they will succeed in it...never mind the "COMMON SENSE" of the people!
    they didnt expect it to get this much attention...Plain & simple as that!!
